Mid-claim broker switching is legal but complicated. Continuity matters at claim time. Here's how to think about it.
Why continuity matters mid-claim
The broker has been the interface with the panel solicitor.
The broker knows the file, the parties, and the strategy.
The insurer knows the broker — and the broker's assessment.
Rebuilding that context takes time you may not have.
When mid-claim switching makes sense
- Current broker has demonstrably failed — e.g., missed notification deadlines.
- Serious dispute with the current broker about strategy.
- Broker firm has been acquired and continuity of individuals lost.
- You've lost confidence in the current broker's competence to handle the specific claim.
- New broker brings genuine specialist expertise the current lacks.
When to wait until claim resolution
- Claim is close to resolution — complete it, then switch.
- Current broker is doing acceptable if not exceptional work.
- You're within 60 days of resolution.
- Switching would delay resolution.
- You're unsure what a new broker would do differently.
If you do switch mid-claim
- Notify all parties: current broker, new broker, insurer, panel solicitor.
- Formal transfer of the claim file — not just summary.
- New broker to review complete history before advising.
- Retain records of why the switch occurred.
- Set expectations with new broker on continuity of strategy.
- Broker's fee arrangement clear — especially if commission split.
What the new broker should do
- Complete file review before intervening.
- Conversation with panel solicitor on defence strategy.
- Direct engagement with the insurer.
- Not second-guess the previous broker's decisions without cause.
- Focus on advancing the claim from where it is, not re-litigating past choices.
