Aipedia: Estate and letting agents

Does estate agents' PI cover AI mistakes?

Estate agents' PI usually responds to negligence claims whether or not AI was involved, but it depends on the wording, exclusions and what you told insurers. AI errors can repeat across many listings or tenancies before anyone notices.

In short

Many estate and letting agents' PI policies may cover claims arising from professional services without mentioning AI, often called silent AI. In many cases an AI-caused error is treated like any other negligent mistake, subject to the terms. Problems can arise from technology or data exclusions, fines and penalties exclusions, aggregation of repeated errors, and non-disclosure at renewal. No statutory PI requirement applies to estate agents, but Propertymark sets minimum limits for Propertymark Protected status, from £100,000 to £500,000, and RICS-regulated firms follow RICS PII requirements. Insurers may ask how you use AI.

Is PI compulsory for estate agents?

No statutory PI requirement for estate agents has been found. The TPO Code does not expressly require PI, though clause 11b says an agent must not hold a deposit or other money belonging to a seller or buyer unless covered by adequate insurance. Propertymark requires evidence of PI for Propertymark Protected status, with firms regulated by RICS or the Law Society of Scotland exempt from providing it:

Firm typeMinimum limit of indemnity
No lettings or management£100,000
Lettings or management, fee income up to £150,000£150,000
Lettings or management, fee income above £150,000£500,000
Client accounting service providers£2m any one claim

Propertymark also requires the policy to cover all work since the business began. RICS-regulated firms follow the RICS PII requirements (version 11 from 1 July 2025); see RICS PI rules for firms.

How PI usually treats AI errors

A PI policy generally covers claims arising from the insured's professional services. Where the wording says nothing about AI, a claim that particulars, an appraisal or a referencing decision were negligent will usually be considered in the normal way, whether the error came from a person or a tool the person failed to check. This is the "silent AI" position: neither excluded nor expressly covered. The question for the insurer is usually the same as for any claim: did the agent fall below the standard of a reasonably competent agent? Relying on a tool is not a defence in itself, and failing to check an obvious error is likely to be treated as the agent's own negligence. Equally, using AI does not of itself remove cover. Where a policy does contain AI-specific wording, whether confirming cover or restricting it, that wording will usually decide the point, so read your own policy rather than assuming. Where gaps can appear

Claim examples by AI use

Illustrative: an agency's data tool mislabels tenure on a number of leasehold flats in one development over several months. Several buyers incur wasted costs. The insurer considers whether the claims arise from one originating cause, which affects how many excesses apply and how the limit is used.

What insurers may ask at renewal

Frequently asked

Does estate agents' PI cover mistakes made by AI?

Usually, if the claim arises from your professional services and no exclusion applies. Where a policy is silent on AI, an AI-caused error is usually treated like any other negligent error, subject to the wording.

What PI limit does Propertymark require?

For Propertymark Protected status: £100,000 with no lettings or management, £150,000 for lettings or management with fee income up to £150,000, £500,000 above that, and £2m any one claim for client accounting service providers.

Should I tell my insurer we use AI?

Answer every proposal question accurately, and if you are unsure whether AI use is relevant, ask your broker. Under-describing how your firm works can create arguments about cover if a claim arises.

Will PI pay fines from trading standards?

Usually not. Fines and penalties are commonly excluded or uninsurable. PI is more likely to respond to compensation claims from clients or third parties, subject to the terms.
