Aipedia: HR consultants
AI can help investigators summarise evidence, but every summary must match the source and sensitive files must not go into unapproved tools. An inaccurate or one-sided report can make a dismissal unfair and lead to a claim against the investigator.
Part of: AI in HR consultants
In short
HR consultants acting as investigators use AI to transcribe interviews, summarise evidence and draft reports. AI summaries can lose nuance, misattribute remarks or adopt one side's framing, and a tribunal may find the investigation unfair as a result. Grievance files often contain special category data, so putting them into public AI tools risks breaching confidentiality and the CIPD duty to safeguard personal data. PI usually covers investigation work within your declared services, subject to the wording, but check defamation cover and how data protection claims are treated.
Workplace investigations generate large amounts of material: interview transcripts, emails, chat logs, CCTV notes and policy documents. HR consultants acting as independent investigators may use AI tools to transcribe interviews, summarise evidence, build chronologies and draft investigation reports. Done well, this saves time. Done badly, it puts words in witnesses' mouths and conclusions in the investigator's report that the evidence does not support.
An investigation report is often central evidence at tribunal. The other side will test it for fairness and accuracy. Common AI-related weaknesses include:
If a tribunal finds the investigation was not reasonable or even-handed, a resulting dismissal or grievance outcome can be found unfair, and the investigator's competence may be criticised.
Transcription tools add their own risks. Accents, crosstalk and technical vocabulary can produce errors that change meaning, and an unchecked transcript may later be disclosed as if it were an accurate record of what was said. Witnesses should be given the chance to confirm their account before it is relied on.
Grievance and disciplinary files often contain allegations of harassment, health information, sexual orientation or other special category data. Putting that material into a public AI tool can breach confidentiality and data protection law. The CIPD Code requires members to safeguard confidential and personal data (professional service and competence, cl.4) and to respect privacy rights (civic virtue and stewardship, cl.5). The CIPD's AI advice flagged data security and GDPR risk with generative AI tools. Witnesses who learn their account was processed by an external AI tool may also complain, and from 19 June 2026 employers must have a data protection complaints procedure (ICO summary of DUAA).
Illustrative: an independent investigator uses an AI tool to summarise twelve interview transcripts in a bullying grievance. The summary attributes a key remark to the wrong witness, and the report relies on it to uphold the complaint. The accused manager is dismissed, brings an unfair dismissal claim and shows the transcript does not support the finding. The client loses and blames the investigator, and the manager also complains that his interview was uploaded to an external tool.
PI for HR consultants usually covers investigation work where it is within the described professional services, subject to the policy terms. Claims can come from the client, and occasionally from individuals named in a report alleging defamation, so check whether your policy includes defamation cover. Data protection claims arising from uploading evidence to AI tools may sit partly outside PI; see AI and employee data confidentiality.
Apex arranges PI for HR consultants who carry out independent investigations. A broker can check that investigation work and defamation risk are within your cover. Related: AI in tribunal paperwork and AI in HR consulting.
Yes, as long as every summary is checked against the original, the tool is approved for confidential data, and the investigator's conclusions rest on the evidence. Key points should be quoted directly rather than paraphrased by AI.
There is no specific rule, but noting it in the methodology is good practice. It shows transparency and makes clear that the investigator, not the tool, weighed the evidence and reached the conclusions.
It can be. Grievance files often contain special category data, and sharing them with an external tool without a lawful basis and proper safeguards may breach data protection law and the CIPD duty to safeguard personal data.
Usually, if investigations are within the professional services your policy describes, subject to the terms. Check for defamation cover and how data protection claims are treated.
