Aipedia: HR consultants
AI can summarise performance data and draft letters, but dismissal and pay decisions need meaningful human involvement or Article 22C safeguards, and a fair process. Advisers who design AI-led processes can face recovery claims when dismissals are challenged.
Part of: AI in HR consultants
In short
AI tools rate staff, summarise performance evidence and draft capability and dismissal letters. Dismissal and pay are significant decisions under UK GDPR, so solely automated outcomes trigger Article 22C safeguards, and the ICO says human review must be active, not tokenistic. Tribunals also expect a fair process and genuine consideration of evidence. Raw comparisons can penalise part-time staff or those returning from leave. When an employer loses a claim, it or its EPL insurer may pursue the consultant who designed the process. PI usually responds, subject to the wording.
AI tools can summarise performance data, draft review comments, rank staff against targets and suggest ratings. Generative AI chatbots may be used to draft capability letters, warning letters and dismissal letters. HR consultants may use these tools for clients who want quicker reviews, or set up systems that generate performance ratings automatically from productivity or sales data.
Dismissal is a significant decision under UK GDPR, and so are decisions on pay. If a dismissal, warning that leads to dismissal, or pay outcome is made with no meaningful human involvement, it is solely automated under Article 22A and the Article 22C safeguards apply: inform the employee, let them make representations, and allow human intervention and challenge. The ICO's draft ADM guidance says review must be active rather than tokenistic and reviewers must understand the system's limits. A manager who signs off an AI-generated rating without looking at the underlying facts is unlikely to meet that test.
Employment law adds its own fairness requirements. A tribunal looking at a capability or conduct dismissal will ask whether the employer genuinely considered the evidence, followed a fair process and reached a decision within the range of reasonable responses. An AI summary that misstates the evidence, or a letter that reaches conclusions the manager never reached, undermines all of that.
See the CIPD Code of Conduct and Ethics.
Illustrative: a consultant sets up a process where an AI tool rates sales staff each quarter from CRM data and drafts a capability letter for anyone rated lowest. Managers send the letters largely unchanged. An employee on reduced hours after returning from maternity leave is rated low because the tool compares raw output, is put on a capability plan and later dismissed. She claims unfair dismissal and sex discrimination. The client argues the adviser designed an unfair process.
The employee's claim is against the employer. The employer, or its EPL insurer, may then look to recover losses from the consultant who designed the process or drafted the letters. A recovery claim usually alleges that the consultant failed to warn about the automated decision rules, failed to build in a fair process or produced letters that misstated the facts.
PI usually responds to recovery claims alleging negligent HR advice or process design, subject to the policy terms and any exclusions for discrimination-related losses. Whether a contract cap protects you depends on your terms; see PI versus terms of business caps.
These steps also help the consultant. If a dismissal is later challenged, a file that shows the manager reviewed the evidence and reached their own view is far easier to defend than one that contains only an AI rating and a templated letter.
Apex arranges PI for HR consultants who design performance and dismissal processes. A broker can check how your wording handles recovery claims from clients and their insurers. Related: AI in redundancy selection, PI versus EPL and AI in HR consulting.
If a dismissal is made with no meaningful human involvement, it is a solely automated significant decision and Article 22C safeguards apply. Tribunals also expect the employer to have genuinely considered the evidence, so AI should support, not replace, the decision.
Only after a manager has checked every statement against the evidence and the letter reflects their own reasoning. A letter that misstates facts or reasons can be used against the employer at tribunal.
It may. If an EPL insurer pays a claim caused by negligent advice, it may seek to recover from the adviser in the client's name. PI usually responds to such claims, subject to the policy terms.
Comparisons that ignore working hours, leave or agreed adjustments can disadvantage women, carers and disabled staff. A fair process looks at output in context, and an adviser designing a ratings system should build that in before the system goes live.
