Aipedia: HR consultants

AI-drafted HR policies and handbooks

AI can draft HR policies and handbooks quickly, but it can introduce out-of-date or non-UK law that a client then relies on. A defective policy can lead to an unfair dismissal claim and a recovery claim against the adviser.

In short

Generative AI can write disciplinary, grievance and absence policies in seconds, but it may use out-of-date rules, non-UK concepts or steps that do not match Acas guidance. The CIPD Code requires an up-to-date, evidence-based service and fair, consistent policies, and the common law duty of care applies to every consultant. When a client follows a flawed AI-drafted procedure and loses a tribunal claim, it may look to its consultant. PI usually responds to negligent drafting claims, subject to the wording.

How consultants use AI for policies

Writing and refreshing staff handbooks is core HR consultancy work. Generative AI chatbots can produce a full disciplinary, grievance, absence or flexible working policy from a short prompt, and can restyle a client's existing handbook. For small clients with no in-house HR, the handbook the consultant supplies is often the only written statement of how the business treats its people.

What slips in

These errors are hard to spot because AI-drafted policies look complete and use the right headings. The gap usually appears only when the policy is tested in a real case, often months or years after it was issued, by which time the consultant may have little record of how it was produced. Clients also tend to copy one policy into several documents, so a single error can spread across contracts, letter templates and manager guidance.

The duties that apply

The CIPD Code of Conduct and Ethics requires members to provide an up-to-date, evidence-based service (professional service and competence, cl.2), to keep skills current (cl.1) and to refer work outside their expertise (cl.3). It also requires fair, consistent and equitable policies (positive and active impact, cl.1). A policy produced by AI and issued without a legal check against current UK sources is hard to square with those duties. Outside the Code, the common law duty to use reasonable skill and care applies to every consultant, member or not. The CIPD's AI guide also expects organisations to set clear policies on generative AI use, which some clients may ask their consultant to draft.

What can go wrong

Illustrative: a consultant uses an AI tool to update a client's disciplinary procedure. The new version drops the right to be accompanied at a hearing and adds a summary dismissal route copied from a non-UK template. The client follows it to dismiss an employee, who claims unfair dismissal and wins, with the tribunal criticising the procedure. The client claims its award, costs and management time from the consultant.

How PI usually responds

Claims that a policy or handbook was negligently drafted are a familiar HR consultant PI risk, and PI usually responds subject to the policy terms, whether or not AI was used. Insurers may ask how the policy was checked. Points to watch are how the policy defines your professional services, any AI clauses, and whether your contract caps liability. Because handbook claims can surface long after the work was done, and PI is usually written on a claims-made basis, the policy in force when the claim is made normally responds, so keeping cover in place after you stop trading matters. Our page on PI for employment law work covers these claims in more detail, and what to document about AI use explains the records that help.

Frequently asked

Can I use AI to draft a staff handbook?

Yes, as a drafting aid. The CIPD Code still expects an up-to-date, evidence-based service, so every provision needs checking against current UK law and Acas guidance before the client relies on it.

Who is liable if an AI-drafted policy causes an unfair dismissal?

The employer faces the employee's claim. If it relied on the consultant's policy, it may claim its losses from the consultant. PI usually responds to that kind of negligence claim, subject to the policy terms.

Does using AI affect my PI cover?

Usually PI covers negligent advice whatever tools produced it, but some policies include AI-specific clauses. Tell your broker how you use AI so they can check the wording against your work.

How often should AI-drafted policies be reviewed?

There is no fixed rule, but employment law changes often and AI tools may lag behind. Agree a review date with the client, flag known upcoming changes in your covering letter, and record that the policy reflects the law at the date of issue.
