AI call notes and sales quality assurance in broking

AI call notes can give a broker better evidence of what it told a client, but only if they are accurate. In an E&O dispute, a wrong or missing note can hurt the broker as much as a good one helps.

In short

Brokers use AI to transcribe sales and service calls, write file notes, fill in CRM fields and score calls for quality assurance. Good notes evidence the advice given, the questions asked and the disclosures made, which is exactly what a broker needs when a client later says it was never told about an exclusion. But AI summaries can drop caveats or invent statements. SYSC 9.1.1R requires orderly records, and data protection law applies to recordings. In a claim, the broker's E&O insurer will rely on these records, so their quality directly affects defensibility.

How brokers use AI on calls

Broking still happens largely on the phone and in video meetings. AI tools now transcribe those calls, produce a summary note, extract actions and populate the client record. Quality assurance tools score every call, rather than a small sample, against a checklist: was the demands and needs question asked, were key exclusions explained, was the customer told about the cooling-off period.

This gives compliance teams far better coverage than manual sampling. It also means the AI note may become the main record of the advice, and staff may stop writing their own.

The duties that apply

The FCA's October 2026 good practice page stresses auditable records for AI use. For a broker, that includes being able to show how a call summary was produced and whether a person reviewed it.

How AI notes help or hurt in disputes

In a broker E&O dispute the central question is often what the client was told. A full transcript can be decisive evidence that the broker explained an exclusion. But a short AI summary that says "cover explained" without detail adds little, and a summary that wrongly records "no claims in five years" when the client mentioned one can damage the broker's case.

Illustrative: a client says its broker never asked about stock held at a second site. The broker's AI note for the call records "all premises declared". The full recording was deleted under a short retention setting, and the note cannot show the question was asked. The broker cannot prove its position.

The reverse also happens. A detailed, time-stamped transcript showing the broker asked about other premises and the client answered "no" will usually be strong evidence for the broker, and may persuade a client or its advisers not to pursue the claim at all.

How PI usually responds

Poor records do not usually remove PI cover, but they make claims harder and more expensive to defend, which can affect the broker's claims record and renewal terms. Broker PI meeting MIPRU 3.2.4R includes legal defence costs, and those costs rise when evidence is weak. For what to document about AI use generally, see AI use and your PI: what to document. On fabricated content, see AI hallucination liability.

How Apex helps

Apex arranges PI for insurance brokers. We can talk through how your record-keeping, including AI call notes, is likely to be viewed by E&O insurers when presenting your firm at renewal.

Frequently asked

Can an AI summary replace a broker's own file note?

It can serve as the file note if it is accurate and reviewed, but it should not replace the underlying recording or transcript. In a dispute, detailed evidence of what was said is far more persuasive than a short summary.

Do brokers need consent to transcribe calls with AI?

Callers should be told that calls are recorded and why. The precise legal basis depends on the purpose and is a data protection question, so check the ICO guidance and your own privacy notices. Telling callers about AI transcription is good practice.

Will poor AI notes affect my E&O cover?

Usually not directly, but they make claims harder to defend, which can increase costs and settlements. That history can then affect your renewal terms, so accurate records are in the firm's commercial interest as well as a regulatory requirement.

Is AI call scoring enough for Consumer Duty monitoring?

It is a useful tool but not a complete answer. The FCA expects firms to monitor outcomes for customers, and call scoring only shows what was said, not whether the customer ended up with suitable cover or a fair outcome.
