Aipedia: Chartered legal executives
AI can summarise bank statements and financial disclosure in divorce cases, but a missed or misread asset can lead to an unfair settlement and a negligence claim. Family files also hold some of the most sensitive data a CILEX lawyer handles.

In short
CILEX family lawyers use AI to summarise months of bank statements, flag unusual transactions and draft first versions of financial statements and position letters. The CILEx Code applies in full: outcome 1.2 for anything filed with the court, 5.1 to 5.4 for competence, 5.12 for confidentiality and 8.2 to 8.4 for supervision. The main risks are assets or transfers the AI misses or misreads, figures carried into court documents unchecked, and sensitive financial and personal data placed in public tools. A client who settles on the basis of a flawed analysis may bring a negligence claim, which PI usually handles subject to the policy terms.
Financial disclosure in divorce can run to hundreds of pages of bank, pension, business and property records. CILEX family practitioners use AI to categorise transactions, total income and outgoings, flag large or unusual payments, and draft summaries for the client, counsel or a schedule of assets. Generative AI chatbots also draft correspondence and first versions of statements.
CRL's AI position leaves the lawyer as decision-maker. Under the CILEx Code of Conduct:
AI summaries are only as good as the documents provided and the instructions given. Common failures include missing regular transfers to an undisclosed account, misreading a business drawing as income, double-counting a transfer between joint accounts, and summarising a pension value from the wrong date. An AI-drafted statement can also include assertions the client never made.
Illustrative: a fee earner asks an AI tool to summarise the other party's bank disclosure. The summary does not flag a pattern of monthly transfers to an account that was never disclosed. The client settles. Later the account comes to light, the client's new solicitors say the transfers should have been questioned, and a negligence claim follows for the difference in outcome.
Financial statements and witness statements in family proceedings are the client's evidence. If an AI tool drafts them, it may smooth over uncertainty, add detail the client did not give, or carry a figure from a summary that was wrong. Outcome 1.2 means a CILEX lawyer must not knowingly or recklessly let the court be misled, and outcome 3.2 forbids intentionally misleading anyone. The Civil Justice Council has consulted on whether lawyers should declare that AI was not used to generate the content of trial witness statements in civil cases, which signals how seriously courts view AI in evidence. Draft from the client's own account and have the client check every line.
Family disclosure combines financial, health and child-related information. Placing it in a public AI tool risks breaching outcome 5.12 and data protection law. In Munir the Upper Tribunal said uploading client documents to a public AI chatbot puts them in the public domain and that firms should consider reporting to the regulator and the ICO. Where a CILEX lawyer works in an SRA firm, the SRA warning notice also requires contractual, technical and organisational safeguards.
Claims that a client settled for less because disclosure was poorly analysed are a familiar type of professional negligence claim, and would usually be considered under the policy subject to its terms, including proof of loss. The CILEX £2m minimum applies regardless of wording for CRL-authorised entities. A data breach can bring a separate claim and regulatory costs; see data breach cover within PI.
Apex arranges PI for CILEX family practitioners and firms, and a broker can explain how your policy treats AI-assisted disclosure work and data incidents. See the AI for CILEX lawyers hub, AI-drafted letters of claim and correspondence, AI client care letters and costs estimates and CILEX lawyers using AI in SRA firms.
Only as a first pass. The CILEx Code requires competent service and supervision, and anything filed with the court engages outcome 1.2. Check the summary against the raw documents and investigate anything unexplained before advising on settlement.
Usually it is the kind of claim PI is designed for, subject to the policy terms. The client will need to show the advice fell below a reasonable standard and that a better outcome was likely, and insurers will want early notice of any complaint.
Only into a secure tool with appropriate safeguards. Disclosure contains confidential personal data and outcome 5.12 applies. Public tools risk putting the material in the public domain, as the Upper Tribunal noted in Munir.
It can help structure a draft, but the statement must be the client's own evidence. Check every assertion and figure with the client before it is signed or filed, because outcome 1.2 prohibits knowingly or recklessly allowing the court to be misled.
