Aipedia: Chartered legal executives
AI can summarise medical records and run quantum calculations in personal injury claims, but an undervalued claim or missed head of loss is the fee earner's responsibility. Personal injury is high-volume work where AI is attractive and errors repeat across files.

In short
CILEX fee earners in personal injury use AI to summarise medical records, draft chronologies, value claims and prepare schedules of loss. The CILEx Code requires competence (outcomes 5.1 to 5.4), confidentiality of health data (5.12) and proper supervision (8.2 to 8.4), and anything filed engages outcome 1.2. The risks are a missed injury or treatment in the records, a head of loss the calculator does not prompt for, and a limitation date that nobody diarised. Under-settlement claims are commonly handled under the firm's PI, whether CILEX or SRA, subject to the policy terms.
Personal injury files are built on medical records, which can run to thousands of pages. AI tools now index and summarise those records, pick out treatment dates and prognoses, and draft chronologies for experts and counsel. Quantum tools suggest general damages brackets and build schedules of loss from payslips, receipts and care evidence. Some case management systems may use AI to triage new enquiries and draft letters to insurers.
CRL's position on AI is that the lawyer remains the decision-maker. Under the CILEx Code of Conduct:
Summaries can drop a secondary injury, misread a consultant's handwriting or miss a later entry that changes the prognosis. Quantum tools only prompt for the heads of loss they were built to recognise, so future care, loss of pension or adaptations may be omitted. The most damaging failure is a limitation date that an AI intake tool records wrongly or not at all.
Illustrative: a fee earner relies on an AI summary of GP and hospital records. The summary does not mention a psychological injury recorded in a later referral letter. The claim settles on the basis of the physical injury alone. When the client's symptoms persist, a new adviser reviews the file and identifies the omission, and the client claims the difference from the firm.
Health data needs particular care. Uploading medical records to a public AI tool risks breaching outcome 5.12 and data protection law; in Munir the Upper Tribunal said uploading client documents to a public chatbot puts them in the public domain. Where AI is used to make or support decisions about claimants without human involvement, the automated decision-making rules introduced by the Data (Use and Access) Act 2025, in force since 5 February 2026, may also be relevant.
A client's claim that their case was undervalued, a head of loss was missed or limitation was lost is a classic professional negligence claim, and would usually be handled under the firm's PI subject to the policy terms. For CRL-authorised entities the £2m minimum applies regardless of wording. CILEX fee earners in SRA firms are usually covered by the firm's policy under the SRA minimum terms. Because volume work can repeat the same error across files, check how your policy aggregates related claims. See a missed limitation scenario and PI for personal injury firms.
Apex arranges PI for CILEX personal injury practitioners and firms, and a broker can review how your policy treats AI-assisted volume work and aggregation. See the AI for CILEX lawyers hub, AI-assisted litigation after Mazur and does CILEX PI cover AI mistakes?.
You can use it as an aid, but valuation remains a matter of professional judgement. Check its output against the evidence, a heads-of-loss checklist and your own knowledge, and have a supervisor review the figure before advising the client on any offer.
A client's claim for a lost case is usually treated as a professional negligence claim, subject to the policy terms, whatever caused the missed date. Notify your insurer promptly once you become aware of the problem.
Only to a secure tool with contractual and technical safeguards. Medical records are special-category data and confidential under outcome 5.12. Public tools risk putting them in the public domain, as the Upper Tribunal noted in Munir.
That is a real risk in volume work. Depending on the wording, related claims may be aggregated into one claim or treated separately, which affects both the limit and the number of excesses. Ask your broker how your policy deals with this.
