Aipedia: Management consultants

Does PI cover AI mistakes by consultants?

Consultants' PI usually covers claims for negligent advice whether or not AI was involved, provided the wording has no relevant AI exclusion. Fee refunds, contractual promises and data breaches may be treated differently.

In short

A PI wording for management consultants may not mention generative AI at all; if so, AI-assisted negligence is usually covered by the general insuring clause, subject to the terms. This is silent AI cover. Some insurers may add AI exclusions or conditions, and others may offer affirmative wording that confirms cover. There is no compulsory PI minimum for consultants, and no regulator statement on AI and PI was found. The main gaps are fee refunds, guarantees, fines and data incidents. Accurate disclosure of AI use at renewal protects the policy.

How consultants' PI is usually written

Consultants' PI policies are often civil liability wordings. They respond to claims alleging breach of professional duty in the course of your professional services, with defence costs commonly included. The insuring clause usually focuses on what you did for the client, not the tools used. A negligent report is negligent whether it was drafted by hand or with a generative AI chatbot.

No statutory or professional-body PI minimum for management consultants was found. Limits and terms are driven by client contracts and frameworks. See our management consultants PI guide.

Silent, excluded and affirmative AI cover

ApproachWhat it meansWhat to check
SilentThe wording does not mention AI; AI-assisted negligence falls under the general coverWhether any other exclusion, such as technology services, could be argued to apply
Excluded or conditionedAI-related claims are excluded or cover depends on controls such as human reviewThe definition of AI and whether conditions are realistic for your practice
AffirmativeThe wording expressly confirms cover for AI-assisted servicesAny sub-limits, and whether it extends to AI you design for clients

More detail is in affirmative versus silent AI cover and AI exclusions and clauses.

Where the gaps usually are

What can go wrong

Illustrative: a consultant's AI-assisted report contains invented evidence. The client wants a refund and also claims the cost of a decision it took on the report. The consultant agrees a partial refund quickly to protect the relationship, then notifies its insurer. The insurer points out that the policy excludes return of fees and that the refund was agreed without consent. The damages claim may still be covered, but the consultant has weakened its position.

A second illustration: a consultant designs an AI triage process for a client and the client later claims it breached automated decision-making rules. If the PI wording treats designing technology as outside professional services, or carries an AI exclusion, the consultant may find the claim falls between PI and any technology or cyber policy. Checking the description of your business on the schedule is a simple first step.

What to tell insurers at renewal

Business insureds owe a duty of fair presentation, so material changes in how you work should be disclosed before renewal. For AI that usually means:

Frequently asked

Is AI-assisted work covered if my policy does not mention AI?

Usually, if the claim alleges negligent professional services and no other exclusion applies. This is silent AI cover. It depends on the wording, so check for exclusions on technology services or automated systems.

Should I tell my insurer I use AI?

Yes, if it is a material part of how you work. The duty of fair presentation requires disclosure of material facts at renewal. Describing your controls accurately also helps the insurer assess the risk fairly.

Does PI cover giving a client its fees back?

Possibly not, or only within a limited extension. Wordings may exclude return of fees, and refunds agreed without insurer consent may not be covered. Notify the insurer before agreeing any refund.

Do I need a separate AI insurance policy?

Not usually for consultants who use AI in their own work, as PI and cyber may address the main risks, subject to the wordings. Firms that build or sell AI products may need specialist technology cover.
