Aipedia: Occupational health providers

AI scribes in occupational health assessments

OH clinicians can use ambient AI scribes in assessments if they tell the worker, respect objections and check every note before relying on it. OH records may be used later in tribunals and disputes, so a scribe error can outlast the consultation.

In short

Ambient AI scribes listen to an OH consultation and produce a structured note or draft report. NHS England's ambient scribing guidance applies to health and care settings in England and is a useful benchmark for OH: complete a DPIA, have clinicians review and approve outputs, explain the use to the worker before processing so they can object, and decide how long audio and transcripts are kept. GMP para 69, NMC Code 10.1 to 10.3 and HCPC standards 10.1 to 10.3 require accurate records whatever tool produced them.

How scribes are used in OH

OH assessments are long conversations about work, symptoms, function and history, and clinicians often type while trying to listen. An ambient scribe records the conversation, transcribes it and produces a note in a set format. Some tools also draft the management report from the same transcript. Telephone and video assessments make this easy to add, and OH providers with high volumes may see time savings.

The duties that apply

The NHS England guidance is written for health and care settings in England; it is not binding on private OH providers but is the most detailed public benchmark.

What can go wrong

Illustrative scenario: during a video assessment about back pain, a worker mentions a disciplinary dispute and their manager's name. The scribe attributes a quoted complaint to the worker that was in fact made by the clinician summarising the referral, and records "no restrictions on lifting" when the clinician had said the opposite. The clinician approves the note quickly. Months later, the note is disclosed in an employment tribunal and both the worker and employer challenge it.

Other risks include recording a worker who did not understand they could refuse, audio stored by a supplier outside agreed terms, and scribes that miss nuance in mental health assessments. A worker who feels recorded without agreement may be less open, which undermines the assessment itself.

How PI usually responds

If a scribe error leads to wrong advice, the claim is usually treated as a claim about the clinician's professional work, and OH professional indemnity commonly responds subject to its terms. Indemnity providers may expect the clinician to be the decision maker, and one medical defence organisation's published AI position excludes software defects and data breaches. A data breach involving stored audio may fall to cyber cover rather than PI, so check how your policies fit together. NHS indemnity does not cover OH work for employers. How Apex helps

Apex arranges professional indemnity for occupational health providers. A broker reviews how your policy treats AI-recorded assessments and whether data held by scribe suppliers falls under PI or cyber cover; see OH professional indemnity.

Frequently asked

Do I need the worker's consent to use an AI scribe?

Consent is often not the lawful basis for health data in employment, but workers should be told about the scribe before it starts and given the chance to object, as the NHS England guidance recommends. Record what you told them and their response.

How long should we keep scribe audio?

The NHS England guidance does not set a retention period. It asks settings to decide how long audio, transcripts and outputs are kept. Set a documented period based on purpose, and make sure your supplier deletes data accordingly.

Is the scribe note my record?

Once you approve it, yes. Good medical practice para 69 and the NMC and HCPC record standards require accurate records, and OH notes may be disclosed in later disputes. Read and correct each note before approving it.

Can a scribe draft the management report too?

Some tools can, but the report must still meet GMC para 7 and para 115: accurate, balanced and limited to relevant information. A transcript contains far more than an employer needs, so the clinician should edit heavily and offer the worker the report first.
