Aipedia: Recruitment agencies

Does recruiters' PI cover AI mistakes?

A recruiter's PI policy usually responds to negligence claims whether or not AI was involved, but discrimination, data and fines are commonly excluded. The answer turns on the wording, so agencies using AI at scale should check it before a claim arrives.

In short

Recruitment agency PI policies usually cover claims alleging negligence in the professional service, such as failing to vet a candidate or passing on wrong information, subject to the wording. Many may say nothing about AI, which is known as silent AI; a claim then usually turns on the ordinary insuring clause and exclusions. Discrimination, data protection, fines and tax may be excluded or limited, and some wordings may address AI expressly. There is no statutory PI requirement for agencies, and no regulator has published a statement on AI and PI. Tell insurers how you use AI at renewal.

What recruiters' PI usually covers

A recruiter's PI policy commonly responds to claims by clients, and sometimes candidates, alleging a negligent act, error or omission in the professional service. Typical examples include placing an unsuitable candidate after inadequate checks, passing on inaccurate information, or breaching confidentiality. No statutory PI requirement for employment agencies or businesses appears in the Conduct Regulations guidance, and no REC or APSCo minimum was verified, so the cover is whatever the policy says. See our recruitment consultants PI guide and, for the general position across professions, does PI cover AI mistakes?.

How AI claims usually fit

AI-related scenarioUsual starting point under PI
Placement made on unchecked AI parsing (reg 19 to 22)Negligence claim by hirer, commonly within cover subject to wording
AI-rewritten CV overstates skillsNegligent misstatement may be covered; deliberate dishonesty commonly excluded
Screening or matching tool disadvantages a protected groupDiscrimination may be excluded or limited
Sourcing tool breaches UK GDPRData liability often limited or left to cyber; fines commonly excluded
Wrong automated IR35 outcomeAdvice claim may be covered; tax itself commonly not
Deepfake candidate placedHirer's negligence claim may be covered; agency's own fraud loss needs crime cover

Each row depends on the specific policy, limit, excess and facts.

Silent AI and AI-specific wording

Where a policy is silent on AI, insurers usually assess the claim as any other professional negligence claim: was there a breach of duty in the professional service? The use of a tool is not normally a reason to decline on its own. Some insurers may add AI exclusions, AI definitions or conditions about human review, while others may offer affirmative wording. See silent AI, affirmative AI cover versus silent AI and AI exclusions and clauses.

Exclusions that matter for AI

Contracts with hirers and suppliers

AI changes the contracts around the policy as well as the policy itself. Hirers may ask for warranties that screening tools are fair or validated, or for indemnities against AI-related claims. Those promises can create liability that would not exist in negligence, and PI commonly excludes liability assumed under contract unless it would have arisen anyway. On the other side, AI suppliers often cap their liability at a low level, so the agency may be unable to pass a loss up the chain. Review both sets of terms alongside your PI wording.

What can go wrong

Illustrative: an agency renews its PI without mentioning that it now screens all applicants with an AI tool and sells video interview scoring to clients. A client later claims after a failed volume campaign, and a group of candidates allege discrimination. The insurer asks why the new service was not disclosed, and the discrimination allegations fall within an exclusion.

What to disclose at renewal

See renewal disclosure. Apex arranges PI for recruitment agencies, and a broker can review your wording against how you use AI. See the AI in recruitment agencies hub, AI checks and reg 19 and AI matching and bias audits.

Frequently asked

Does recruitment PI cover mistakes made by AI tools?

Usually it responds to negligence claims about the professional service whether or not AI was used, subject to the wording. Discrimination, data protection, fines and tax may be excluded or limited, and some policies may address AI expressly. Read the definitions and exclusions.

What is silent AI?

A policy that neither covers nor excludes AI expressly. Claims are then assessed under the ordinary insuring clause and exclusions. Silent wording can work in your favour, but it leaves room for argument, so it is worth confirming the insurer's position.

Do I need to tell my insurer we use AI?

You should disclose material changes to your business at renewal, and a move to automated screening, matching or AI-based services is likely to be material. Non-disclosure can affect a claim. Give clear details of tools, services and controls.

Is there a minimum PI requirement for recruitment agencies?

No statutory PI requirement for employment agencies or businesses was found in the Conduct Regulations guidance, and no REC or APSCo minimum was verified. Hirers commonly set their own requirements in terms of business.

Will PI cover a claim if our AI supplier was at fault?

PI may respond to the claim against the agency, subject to the wording, and the insurer may then seek to recover from the supplier. Low liability caps in supplier contracts can limit that recovery, which insurers may take into account.
