AI for bursars: budgets, procurement and contracts

Bursars and school business managers can use AI for forecasts, tenders and contract reviews, but the trust board stays accountable for the financial decisions that follow. An AI error usually costs the school its own money, which insurance often does not replace.

In short

School business managers and bursars use AI to build budget forecasts, draft tender documents and summarise supplier contracts. The Academy Trust Handbook 2026, effective 1 October 2026, has no AI-specific content, but clarifies procurement of energy and MIS at paragraphs 2.29 and 2.30. DfE's data protection guidance added an EdTech procurement section in July 2026. A forecasting error or a missed contract clause usually causes the trust its own loss, which PI does not normally cover. Governors' liability may respond if trustees are later blamed, subject to its exclusions.

How school finance teams use AI

Finance work in schools is document-heavy and time-pressured. Bursars and school business managers use AI assistants to model pupil number scenarios and staffing costs, draft three-year budget narratives for trust boards, write tender specifications, compare quotes, and summarise long supplier contracts for MIS, catering, cleaning or energy. Some finance systems now include AI forecasting. The common thread is that AI produces confident, well-formatted output that boards may treat as checked when it has not been.

What the Academy Trust Handbook and DfE expect

The Academy Trust Handbook 2026, effective 1 October 2026 (the 2025 edition applied from 1 September 2025), has no AI-specific content on its landing page. Its 2026 changes clarify procurement of energy and management information systems (MIS) at paragraphs 2.29 and 2.30. MIS contracts may bundle AI features, so a bursar procuring an MIS may also be procuring AI processing of pupil data.

The Data protection in schools update log shows a link to Local Government Association guidance on AI procurement added in September 2025 and a new EdTech procurement section in July 2026. DfE's Generative AI in education policy confirms that a document remains the professional's and the organisation's responsibility regardless of the tools used, which applies equally to a budget paper or tender. Where the trust is a charity, trustees owe the duty of reasonable care and skill described in the Charity Commission's CC3, which includes taking advice when necessary.

What can go wrong

Illustrative scenario: a trust's business manager uses an AI assistant to summarise a five-year MIS and cloud services contract before renewal. The summary omits an automatic renewal clause and a clause allowing the supplier to process data for product improvement. The board approves on the strength of the summary. The trust is locked in for a further term at a higher price, and the DPO later finds the data clause conflicts with the trust's privacy notice. Elsewhere, an AI-built forecast double-counts a grant, and the board sets a budget that has to be revised mid-year with staffing consequences.

Does governors' liability or PI respond?

The answer often disappoints. These are mostly first-party losses: the trust has lost its own money. PI usually covers liability to third parties for breach of professional duty, so it is not normally designed to repay a school's own contract or budget losses. RPA Section 6 is likewise framed around claims for breach of professional duty.

Governors' liability is relevant where someone later claims against the trustees for the decision. Under the RPA rules, Section 5 covers trustees for claims-made losses, subject to exclusions such as personal profit, dishonesty, and acts known to be a breach of duty or done in reckless disregard. A supplier dispute arising from an AI-drafted tender may produce a third-party claim, which depends on the facts and the wording. Fraud enabled by AI is a separate question for crime or cyber cover; see AI-powered cyber attacks on schools.

How Apex helps

Apex arranges D&O for academy trusts and schools and trustee indemnity for independent schools that are charities. A broker can explain what your programme would and would not cover after a financial error, and how crime cover fits alongside it.

Frequently asked

Does the Academy Trust Handbook say anything about AI?

No AI-specific content was found on the Academy Trust Handbook landing page. The 2026 edition, effective 1 October 2026, clarifies procurement of energy and management information systems at paragraphs 2.29 and 2.30, which can include AI-enabled MIS contracts.

Will PI cover a loss caused by an AI budget error?

Usually not. PI is generally designed for third-party claims alleging breach of professional duty, not for a school's own financial losses. If a third party claims, or trustees are later blamed, other covers may be relevant, subject to the wording.

Should the DPO be involved in buying an AI-enabled MIS?

Yes. DfE says personal data should only go into AI tools the school has approved after DPO or IT lead checks, and that data must not be used to further train the AI. Contract clauses on supplier data use need checking before signature.

Who is accountable if the board relies on an AI summary?

The board. DfE says documents remain the responsibility of the professional and organisation regardless of the tools used, and charity trustees must act with reasonable care and skill. Minutes should show what was relied on and how it was checked.
