Aipedia: Training providers and educators
Training providers' PI usually responds to claims arising from AI-assisted work in the same way as other negligence claims, subject to the policy terms. Gaps arise from AI clauses, activity descriptions, and exclusions for data, injury or certification.

In short
There is no statutory PI requirement for training providers and no regulator statement on AI and PI, so cover depends on your policy. Many trainers' PI policies cover the professional activity regardless of tools, so negligent AI-assisted content, marking or advice is usually assessed on normal terms. Cover can fall short through AI clauses, outdated activity descriptions, certification or regulated qualification limits, data and injury exclusions, contractual liabilities and aggregation. Make a fair presentation at renewal, describe your AI use, and keep human review records.
There is no statutory PI requirement for training providers, and no regulator has published a statement on AI and PI for the sector. Whether you are covered for an AI-related mistake therefore depends on the policy you hold. Many trainers' PI policies are written around the activity, not the tool: they cover claims alleging that you breached your professional duty in providing training, assessment, coaching or advice. If a negligent course, mark or piece of advice was produced with AI help, the claim will usually be considered on the normal terms. Our general guide on whether PI covers AI mistakes explains the wider market position.
Duties behind these claims come from contract and reasonable care, and for schools and colleges from guidance such as the DfE's generative AI in education guidance, which says the professional and organisation remain responsible for documents produced with AI. In regulated qualifications, Ofqual says AI may not be a sole marker.
Under the Insurance Act 2015, business insureds must make a fair presentation of the risk. In practice, insurers may ask about AI use. Be ready to describe which tools you use and for what, whether AI marks or makes decisions about learners, whether you run learner-facing chatbots, what human review is in place, and how learner data is protected. See renewal disclosure and PI for AI-using professionals.
Illustrative scenario: a provider adds AI-assisted marking to its online courses but its renewal presentation describes only face-to-face delivery. When learners claim for incorrect marks, the insurer questions whether online assessment was disclosed. Clear disclosure at renewal would have avoided the argument.
Apex arranges PI for training providers and educators. A broker reviews your cover, how it describes your activities and how it treats AI-assisted work. See the training providers Aipedia hub, whether training providers need PI and telling learners and clients you use AI.
Usually the claim is assessed on the normal terms, because many policies cover the professional activity regardless of the tools used. Cover can still be affected by AI clauses, the way your activities are described, and exclusions for data, injury or contractual liability. Check your wording.
You must make a fair presentation of the risk. If AI changes how you deliver, mark or support learners, it is sensible to describe it, and some proposal forms may ask directly. Non-disclosure can lead to disputes about cover after a claim.
No statutory PI requirement for training providers was found. Clients, funders and awarding bodies may require it by contract, often with a set limit. Even where not required, it is the main protection against negligence claims from learners and clients.
It depends on the wording. Some PI policies cover civil claims for breach of confidentiality or data protection; others exclude data matters and leave them to cyber cover. Fines are often uninsurable. Check how your PI and cyber policies fit together.
