Aipedia: Debt advice firms
AI can build a debt client's income and expenditure budget, but CONC 8 still requires a sufficiently full and reliable assessment of their finances before any advice. Every recommendation and creditor offer rests on that budget, so an error in it travels through the whole case.
Part of: AI in Debt advice firms
In short
Open-banking and AI tools can categorise months of transactions in seconds and produce a draft financial statement. CONC 8.3.2R(1)(c) requires advice to rest on a sufficiently full assessment of the customer's financial circumstances, and CONC 8.3.7R(2) requires a reasonable and reliable assessment before advising. A model that misreads cash spending, misses a priority bill or treats a one-off as regular can make a plan unaffordable from day one. A trained adviser should test the figures with the customer and record what changed. PI usually responds to negligence claims about failed plans, subject to the wording.
The financial statement is the foundation of debt advice. Traditionally an adviser asks the customer about each income source and spending category and fills in a standard form. AI and open-banking tools now shortcut that work by:
For free-to-client agencies under volume pressure this can release adviser time. For fee-charging firms it speeds up onboarding. Either way, the draft becomes the number everything else is built on.
Full assessment. CONC 8.3.2R(1)(c) requires advice to be based on a sufficiently full assessment of the customer's financial circumstances. CONC 8.3.7R(2) requires a reasonable and reliable assessment of finances and circumstances before advice is given. A tool that only sees one bank account, or cannot see cash, will not on its own satisfy either rule.
Affordability. CONC 8.2.2G says recommending a solution the firm knows or ought to suspect is unaffordable is likely to breach Principles 2, 6 and 9 and the Consumer Duty. An inflated surplus produced by a tool is exactly the kind of figure a firm "ought to suspect".
Offers. CONC 8.5.3G expects offers to lenders to be realistic and sustainable, leaving room for essential costs and priority obligations. See AI creditor offers and payment proposals.
Consumer Duty. The FCA's October 2026 good-practice page expects firms to test AI outcomes across consumer characteristics. A budgeting model that works well for salaried customers but poorly for people with irregular or cash income is a foreseeable gap.
Illustrative scenario: a customer on variable shift income shares one current account. The tool averages three good months, treats food bought with cash as non-existent and files a council tax direct debit as discretionary. The adviser accepts the draft. A debt management plan is set at a level the customer cannot keep up, council tax arrears grow and enforcement starts. The customer later complains that the plan was unaffordable from the outset.
Typical failure points include:
The harm is rarely visible at the point of advice. It shows up months later as missed payments, a failed plan or a creditor that will not accept a revised offer, by which time the original data and the adviser's reasoning may be hard to reconstruct. That is why keeping the reviewed budget, not just the final figures, matters.
A claim that negligent advice, built on a wrong budget, caused loss is the kind of civil liability PI is usually designed for, subject to the terms, excess and any technology exclusions. No FCA PI requirement for debt advice firms was found, so cover is voluntary and the wording governs. Complaints that do not become claims, and fines, are commonly outside cover. Apex arranges PI for debt advice firms. A broker can check how your wording treats claims arising from automated budgeting. See the AI in debt advice hub.
It can be a strong starting point, but CONC 8.3.2R(1)(c) and 8.3.7R(2) require a full and reliable assessment. Transaction data rarely shows cash spending, other accounts or changes ahead, so an adviser should confirm the figures with the customer and record that check.
The firm. The FCA says firms remain responsible for outcomes, including where AI is outsourced. A firm may have rights against its software supplier under contract, but the customer's complaint and any claim will be against the firm.
Often PI responds to a negligence claim regardless of whether a tool was involved, subject to the wording, excess and exclusions. Because debt advice PI is voluntary, check whether your policy has any technology or AI conditions and tell your insurer how budgets are prepared.
