Aipedia: Estate and letting agents
Compliance software helps letting agents track deadlines, but the agent remains responsible to the landlord if a certificate, deposit step or right to rent check is missed. Lettings compliance failures can cost landlords their ability to regain possession, as well as fines.

In short
Lettings platforms can use automation and AI to read certificates, chase contractors, track expiry dates, register deposits and run right to rent checks. When a document is misread or a reminder fails, the landlord may face penalties or lose legal remedies and will look to the agent. Agents holding client money must belong to an approved client money protection scheme under regulation 3 of the 2019 Regulations, and the National Trading Standards Letting Agency Team can issue financial penalties for missing redress or CMP membership. Propertymark sets higher PI minimums for lettings firms. PI may respond to negligence claims, subject to the wording.
A managed let involves a long list of recurring tasks: safety certificates and inspections, deposit registration and paperwork, right to rent checks, licensing, inventories and renewals. Compliance platforms can read uploaded certificates with optical character recognition and AI, extract the dates, set reminders, chase contractors by message and show a dashboard of red and green items. Some automatically register deposits and generate prescribed information. Others run digital identity checks for right to rent.
The dashboard is only as good as what went into it. If a certificate is misread, uploaded to the wrong property or never uploaded at all, the system may show green when the position is red.
There is also a gap between tracking and doing. Software can tell an agent that a document is due, but it cannot attend the property, judge whether a contractor's report is complete or decide what to do when a tenant refuses access. Staff who trust a green screen may stop asking those questions.
Illustrative: a letting agent relies on its compliance dashboard for a portfolio landlord. The AI reads an uploaded safety certificate for one flat and records it against a different flat in the same building. The dashboard shows both flats as compliant. Months later the landlord tries to regain possession of the first flat and is told the paperwork is defective. The landlord claims the delay, lost rent and legal costs from the agent.
A landlord's claim that the agent negligently failed to manage a compliance step will usually fall to be considered under a letting agent's PI policy, subject to the wording and the scope of services agreed. Fines and penalties imposed on the agent are commonly excluded or limited. Deposit and client money losses can sit awkwardly between PI, crime and client money protection; our deposit handling and PI overlap guide explains how. Propertymark minimum PI limits are £150,000 for lettings or management firms with fee income up to £150,000, and £500,000 above that.
How Apex helps: Apex arranges PI for letting and managing agents. A broker can review how your cover treats compliance failures and client money. See AI in estate and letting agency, AI in property management and PI for new letting agents.
The landlord will usually pursue the agent, whose duty comes from the agency agreement. The agent may have a claim against the software provider, depending on its contract terms, which may limit liability.
Yes, if they hold client money. Regulation 3 of the Client Money Protection Schemes for Property Agents Regulations 2019 requires membership of an approved scheme, and regulations 6 and 7 provide for financial penalties.
For Propertymark Protected status, lettings or management firms need £150,000 with fee income up to £150,000, and £500,000 above that. Firms regulated by RICS or the Law Society of Scotland are exempt from providing evidence to Propertymark.
Usually not. Fines and penalties are commonly excluded or uninsurable. A landlord's compensation claim arising from the agent's error is more likely to be considered under PI, subject to the wording.
