Aipedia: Mortgage brokers

AI document reading and mortgage fraud

AI document tools help brokers read and check payslips, statements and ID, but they do not shift responsibility for what the broker sends to a lender. If a forged document slips through, the lender may pursue the broker, and lender claims can be among the larger PI risks for mortgage firms.

In short

Brokers use OCR and AI to extract figures from payslips, bank statements, tax documents and ID, and some tools score documents for signs of editing. This speeds up packaging but can create false confidence: a clean extraction is not proof that the document is genuine, and a fraud score can miss sophisticated forgeries. If a lender advances money on doctored documents and suffers a loss, it may claim against the broker for failing to spot obvious warning signs. PI usually responds to an honest broker's negligence, subject to the terms, but dishonesty is commonly excluded.

How brokers use AI on documents

Document tools read uploaded files, extract names, dates, salaries and balances, and populate the case. Checks then compare figures across documents: does the payslip net pay match the bank credit, does the employer name match, do the dates line up? Some tools look at file metadata, fonts and layout for signs that a PDF has been edited. Packagers and networks may run similar checks again before submission.

The duties that apply

What can go wrong

Illustrative scenario: an applicant uploads payslips and bank statements that have been edited to inflate salary. The AI tool extracts the figures cleanly and its tamper check passes, because the forger used the employer's real template. The adviser, reassured by the green result, does not notice that the bank credits are round numbers that do not match the payslip net pay. The borrower defaults, the property is sold at a loss, and the lender alleges the broker should have spotted the inconsistency.

Other problems include OCR misreading a figure so the case is overstated without any fraud, a tool that is not designed to check certain document types, and advisers who stop looking at documents themselves because the tool appears to do it.

Fraud is also getting easier to produce. Generative tools can create convincing payslips and statements, so a document check that worked well a year ago may now miss more. Packagers, networks and lenders may run their own checks, but a broker cannot assume someone further down the chain will catch what it missed, and the existence of later checks is unlikely to excuse the broker's own carelessness.

Lender claims and PI

Lender claims are a significant category of mortgage-related professional liability, as the Apex summary of Mortgage Express v Countrywide illustrates in a lender claim against a professional. For brokers, losses can be large because they reflect the shortfall on the loan rather than a fee.

A policy meeting MIPRU 3.2.4R must cover the conduct of the firm, employees and appointed representatives, and legal defence costs. A claim that an honest broker carelessly missed signs of fraud is usually treated as negligence, subject to the wording. Where the broker or an employee was involved in the fraud, policies commonly exclude the dishonest person while sometimes protecting the innocent firm, depending on the terms. Whether a series of frauds counts as one claim or many will depend on the aggregation clause: see aggregation of claims in PI.

Frequently asked

Does a passed AI fraud check protect the broker?

It helps show the broker took steps, but it is not a defence on its own. If there were warning signs a reasonable adviser would have noticed, relying on a green result may not be enough.

Can a lender sue a mortgage broker?

Lenders can bring claims against brokers where they allege the broker's negligence or breach of the broker agreement caused a loss, for example by submitting documents that should have raised concerns. The outcome depends on the facts and the terms.

Should brokers tell their insurer about suspected fraud on a past case?

PI policies usually require notification of circumstances that may give rise to a claim. If you discover that a completed case involved forged documents, check your notification condition and speak to your broker promptly. Late notification can create problems with cover.

Is mortgage fraud by a borrower covered by PI?

PI covers the broker's liability, not the fraud itself. If an honest broker is accused of carelessly missing a borrower's fraud, PI usually responds, subject to the policy terms. Dishonesty by the broker or its staff is commonly excluded for those involved.
