AI in mortgage broking: rules, risks and PI

UK mortgage brokers can use AI in sourcing, fact-finds and paperwork, but the FCA expects qualified advisers to stay accountable for every recommendation. Because PI is compulsory under MIPRU, how a policy treats AI-assisted advice matters to every firm.

In short

AI is spreading through the mortgage advice process: sourcing and criteria tools, open banking affordability analysis, document reading, call transcription and drafted recommendation letters. The FCA has not written AI-specific rules and says it does not plan to. Instead, FS25/6 records a strong view that AI should support advisers rather than replace them, and the Consumer Duty, the conduct rules and SM&CR already apply. Brokers must hold PI under MIPRU 3.2, and that cover usually responds to negligent advice whether or not a tool was involved, subject to the policy terms.

How mortgage brokers use AI

AI now touches most stages of a mortgage case. Before advice, website and messaging chatbots answer first questions and collect details. At the fact-find, transcription tools record the interview and fill in the client file. During research, sourcing systems match the borrower to lenders, products and criteria, and open banking tools categorise income and spending for affordability. Document tools read payslips, bank statements, tax calculations and ID, and some flag signs of tampering. After the recommendation, generative AI drafts the suitability letter, and retention systems send rate-expiry alerts and steer clients towards product transfers.

Networks use similar tools to sample appointed representatives' files. Protection advice alongside the mortgage is increasingly supported by needs-analysis and quote engines. Each of these uses saves time, and each creates a new way for an error to reach a client file without anyone noticing.

What the FCA has said

The most mortgage-specific statement is FS25/6, the December 2025 feedback to the Mortgage Rule Review. Respondents showed strong consensus that AI should improve advice, not replace advisers, and that "human judgement remains essential, especially in complex cases" (paras 4.22 to 4.23). Some asked for qualified advisers to review and sign off AI-based recommendations, and warned that AI could "hallucinate or produce incomplete data" (4.24 to 4.26). The FCA said the Consumer Duty and SM&CR "can already manage many of the risks" (4.25).

Across financial services, the FCA's AI approach page says "We do not plan to introduce extra regulations for AI." Its October 2026 good practice review sets no new requirements but stresses that firms "remain responsible for consumer outcomes", including for outsourced AI. For the detail, see FCA rules on AI for mortgage brokers.

The duties that apply

The main risks

The risks follow the advice chain. Outdated criteria can send a case to the wrong lender and cost the borrower a rate. Affordability tools can overstate income. Document tools can miss doctored payslips, leading to lender claims. Drafted letters can describe advice that was never given, which weakens the firm's defence at the Financial Ombudsman Service. Notetakers raise consent questions, especially where health data is discussed for protection. Chatbots can stray into personal recommendations. Automated retention journeys can miss a client altogether.

No UK FCA enforcement action, FOS decision or court ruling turning on a mortgage broker's use of AI has been found. The Ombudsman told the Mills Review in April 2026 that it sees "very few complaints about a firm's use of AI", but it wants a clear rationale on how AI contributed to an outcome.

The PI position

MIPRU 3.2.1R requires a mortgage intermediary to take out and maintain PI. MIPRU 3.2.4R requires the policy to cover the conduct of the firm, its employees and its appointed representatives, legal defence costs and Ombudsman awards. Minimum limits depend on the firm's permissions, and firms that also arrange protection insurance must meet the higher insurance distribution limits. The full requirements are on FCA PI requirements for mortgage and home finance brokers.

The FCA has said nothing specific about AI and PI. In general, a mortgage PI policy is concerned with whether advice was negligent rather than whether a tool contributed, so AI-assisted errors are commonly treated like any other error, subject to the wording. Exclusions, definitions of professional services and renewal questions about technology can change that. See Does broker PI cover AI mistakes? and the mortgage broker PI guide.

Frequently asked

Has the FCA banned or restricted AI in mortgage advice?

No. The FCA says it does not plan to introduce extra regulations for AI. Existing rules, including the Consumer Duty, the conduct rules, SM&CR and the MCOB advice rules, apply to AI-assisted advice. FS25/6 records strong support for AI improving advice rather than replacing advisers.

Who is responsible if a sourcing or AI tool gets it wrong?

The firm. SYSC 8.1.6R keeps a firm fully responsible for outsourced functions, and the FCA's 2026 good practice review says firms can outsource AI services but remain responsible for them. The individual adviser also has conduct duties under COCON.

Does mortgage broker PI cover AI errors?

Usually a claim is assessed on whether the advice was negligent, not on whether a tool was used, so AI-assisted errors are commonly handled like other errors. It depends on the wording, any technology or AI exclusions, and whether you disclosed your use of AI accurately when asked.

Has anyone been fined for misusing AI in mortgage advice?

No verified UK FCA enforcement action, Ombudsman decision or court ruling turning on a mortgage broker's use of AI has been found. The Ombudsman reports very few complaints about firms' use of AI so far, though that may change as use grows.
