Aipedia: Mortgage brokers
A broker using AI for protection advice must still specify the customer's demands and needs and propose only consistent cover, under ICOBS 5.2. Protection mistakes often surface only when a claim is declined, when the loss to the family can be far larger than a mortgage error.
Part of: AI in Mortgage brokers
In short
Mortgage brokers commonly advise on life, critical illness and income protection alongside the mortgage. AI needs-analysis tools suggest cover amounts and types, quote engines compare insurers, and some tools pre-fill application answers from the fact-find. ICOBS 5.2.2R(1) and 5.2.2BR require the customer's demands and needs to be specified and any proposed contract to be consistent with them. The biggest risk is a health or lifestyle answer pre-filled wrongly, which can lead to a declined claim. Firms doing insurance distribution face higher MIPRU PI minimum limits.
Needs-analysis tools take mortgage size, income, dependants and existing cover and suggest how much life, critical illness and income protection a borrower might need. Quote engines then search insurers and rank options. Increasingly, tools carry fact-find data straight into the application, including health and lifestyle questions, so the borrower only confirms. AI notetakers may supply that fact-find data, as covered in AI notetakers in fact-finds.
Illustrative scenario: a borrower mentions in the mortgage fact-find that they saw a doctor about back pain last year. The protection tool pre-fills the income protection application from the fact-find, but the back pain is not mapped to the relevant health question, which defaults to "no". The borrower confirms the application without reading each answer. Two years later they claim for a back condition, the insurer finds the earlier consultation, and the claim is refused or reduced. The borrower says the broker filled in the form.
Other problems include tools suggesting decreasing term cover where level cover was needed, ranking on price without regard to definitions, ignoring existing employer benefits, and using out-of-date occupation classes.
Protection errors are also slow to appear. A mortgage problem usually shows up within months, but a wrongly answered health question may sit unnoticed until a claim years later, by which time the adviser may have left and the tool may have changed. That makes a clear record of what the borrower was shown and confirmed especially important.
If the borrower's claim fails because of the broker's negligent advice or form completion, the borrower may seek from the broker what the insurer would have paid. That can be far larger than most mortgage complaints. PI is designed for this kind of claim, subject to the terms, and a policy meeting MIPRU 3.2.4R must cover Ombudsman awards and defence costs.
Firms that also carry on insurance distribution must hold the higher of the mortgage and insurance distribution minimum limits (MIPRU 3.2.2G). The insurance distribution minimum is EUR 1,300,380 per claim and EUR 1,924,560 in aggregate, or 10% of income capped at £30m (MIPRU 3.2.7R). Check your limit reflects your protection business; see FCA PI requirements for mortgage brokers.
Apex arranges PI for mortgage and protection advisers and can check that your limit meets the higher insurance distribution minimum. See the mortgage broker AI hub and whether broker PI covers AI mistakes.
Tools can, but the answers must be accurate and the borrower should confirm each one. If a pre-filled answer is wrong, the insurer may refuse or reduce a later claim, and the borrower may look to the broker for the loss.
Not on its own. ICOBS 5.2.2R(1) requires the firm to specify the customer's demands and needs, and ICOBS 5.2.2BR requires the proposed contract to be consistent with them. A tool can support that work but does not replace the adviser's judgement.
It depends on the facts. If the broker pre-filled the answer and the borrower confirmed it without a fair chance to check, the borrower may argue the broker was careless. A record showing each question was read and confirmed helps the broker considerably.
The higher of the mortgage and insurance distribution minimums under MIPRU. The insurance distribution minimum is EUR 1,300,380 per claim and EUR 1,924,560 in aggregate, or 10% of income capped at £30m. Some firms choose more than the minimum.
