Aipedia: Patent and trade mark attorneys

AI docketing, renewals and deadlines

Automated and AI docketing can track thousands of renewal and procedural deadlines, but a single misread date or dropped record can lapse a right. Missed deadlines are a serious PI concern for attorney firms because the loss is clear and the error is easy to show.

In short

IP firms use docketing systems that extract dates from office letters, calculate deadlines and send reminders, sometimes with AI reading the documents. Errors come from misread letters, wrong rules, failed migrations and instructions not logged. Restoration of a lapsed right is not automatic and may not be available. IPReg's AI guidance points to existing duties of competence, supervision and records, which cover records staff and vendors. A claim for a lapsed right usually falls under IPReg-compliant PI, subject to the policy terms. Vendor contracts and records matter if the insurer seeks recovery.

How AI is used in docketing

Records teams manage renewal fees and procedural deadlines across many offices. Docketing systems hold the rules for calculating deadlines. AI can be used to read incoming office letters and emails, extract dates and actions, match them to the right case and create diary entries. Some systems also process client instructions and send renewal reminders automatically, or pass payments to renewal agents.

Automation reduces keying errors, but it changes where errors happen. A misclassified letter, a wrong rule after a change in office practice, or a data migration that drops records can affect many cases at once, and may not be noticed until a right has lapsed.

The duties that apply

Lapsed rights and restoration limits

When a renewal or procedural deadline is missed, the first question is whether the right can be saved. Restoration or reinstatement is not automatic. It typically depends on applying within a time limit and meeting the relevant test for the failure, and third parties may acquire rights in the meantime. Some deadlines cannot be remedied at all. A firm that finds a lapse should act at once: delay can close the routes to recovery and increase the loss.

Illustrative scenario: a firm moves to a new docketing system with AI letter reading. The migration maps one status field incorrectly, so a group of patents is shown as abandoned on instructions and drops out of the renewal run. The lapses are found months later during a client's due diligence. Some can be restored; others cannot. The client claims for the lost rights and for the delay to its transaction.

How PI usually responds

Claims for lapsed rights caused by a docketing error would usually fall within IPReg-compliant PI as negligence, subject to the policy terms, whether the error came from a person, a rule or an AI tool. Policies usually require prompt notification as soon as a lapse is found, and may want to be involved in restoration steps, since these reduce the loss. Several lapses from one cause may be treated as one claim or several depending on the aggregation clause. Where a vendor's system caused the error, the insurer may seek recovery from it, depending on the contract; see subrogation. See also late notification.

Practical controls

How Apex helps

Apex arranges PI for patent and trade mark attorneys. A broker can check how your policy treats deadline claims and what insurers should know about a new docketing system. See the attorneys hub, AI trade mark watching and does attorneys' PI cover AI mistakes.

Frequently asked

Is the firm liable if docketing software misses a deadline?

Usually the firm remains responsible to the client for the service, whatever system it used. IPReg's guidance points to existing duties of competence and supervision. The firm may have rights against the vendor, depending on the contract.

Can a lapsed patent or trade mark always be restored?

No. Restoration or reinstatement typically depends on acting within a time limit and meeting the relevant test, and some deadlines cannot be remedied at all. Act immediately when a lapse is found, and notify your insurer.

Can we delegate renewals to an AI system or a renewal agent?

You can delegate the work, but not the responsibility. IPReg's guidance points to existing supervision duties, so the firm needs checks that the system or agent is acting on correct data and instructions, and a way to spot failures quickly.

Should we tell our insurer about a new docketing system?

It is sensible to. A change in how deadlines are managed may be material under the duty of fair presentation, and some proposal forms ask about systems and procedures. Describe the controls you have put in place around it.
