Independent social workers: does PI cover AI-assisted work?

An independent social worker's PI policy usually responds to negligent professional work whether or not AI helped produce it, subject to the wording and any exclusions. Independent and agency social workers carry risks that employed colleagues leave to their employer.

In short

Most social workers are employed and rely on their employer's arrangements. Independent social workers, and some agency and locum workers, do not have that protection. BASW guidance says independent social workers should maintain adequate professional indemnity and public liability cover. A PI policy is commonly written around the professional services you provide rather than the tools you use, so an AI-assisted report or assessment is usually treated like any other work, subject to the terms. The points to check are the definition of professional services, any AI, technology or data exclusions, confidentiality cover, regulatory defence costs and run-off.

Why independent social workers need their own PI

Independent social workers carry out assessments, reports for proceedings, reviews, practice education and consultancy for councils, agencies, solicitors and families. If a client or third party alleges that work was negligent, there is no employer to step in. BASW guidance for independent social workers says they should maintain "adequate professional indemnity and public liability insurance cover".

Social Work England's professional standards contain no PI requirement. Commissioners may set their own insurance requirements in contracts. For the basics, see PI for social workers and children's services, PI when going independent and public liability insurance.

Agency and locum social workers

Agency and locum social workers sit in between. Some are treated as covered by the agency's or the client authority's arrangements; others are expected to hold their own cover. The position depends on the contract chain, so ask both the agency and the authority in writing. See PI for locum professionals and can an employer require PI?.

How AI-assisted work is usually treated

A PI policy commonly covers claims arising from the professional services described in the schedule. It does not usually matter whether you typed a report, dictated it or used an AI tool to draft parts of it; the question is whether the work was negligent. That is the general position explained in does PI cover AI mistakes?.

BASW's guidance, as reported by Community Care, places accountability on the social worker, and SWE's research says social workers should be responsible for the accuracy of their recordings and how they use AI. That fits the way PI works: the AI tool is not the insured, you are.

Wording to check

Points to check in your wording include:

What can go wrong

Illustrative scenario: an independent social worker uses an AI tool to draft a parenting assessment for a solicitor. A factual error about the family's history goes unnoticed and the report is criticised. The client alleges the work was negligent and seeks the cost of a replacement assessment. The independent social worker notifies their insurer. Whether the policy responds turns on its professional services definition and whether any exclusion applies, not on the fact that AI was used.

Practical steps

Independent social workers can take these steps:

Related: AI in court statements, AI errors and fitness to practise and the AI in social work hub.

Frequently asked

Do independent social workers need PI?

BASW guidance says independent social workers should maintain adequate professional indemnity and public liability cover. Social Work England's standards contain no PI requirement, but commissioners may require cover in their contracts, and without it you carry claims personally.

Does PI cover a report I drafted with AI?

Usually the policy covers negligent professional work regardless of how it was drafted, subject to the terms. Check for AI, technology or data exclusions and make sure your professional services definition includes report writing.

Should I tell my insurer I use AI?

Yes. Telling your insurer, through your broker, which AI tools you use and for what helps avoid disputes about non-disclosure and lets you check whether any exclusion applies. It also gives you the chance to ask how the wording treats that work.

Does PI cover a Social Work England investigation?

Some PI policies include cover for defence costs in regulatory investigations; others do not, or limit it. Fines and sanctions are generally not covered. Check the wording and ask your broker.
