Aipedia: Tax advisers
Generative AI can suggest tax planning ideas, but some will be contrived or legally uncertain, and an adviser who passes them on is responsible under PCRT. Planning claims are among the most expensive a tax adviser can face.

In short
Ask a generative AI chatbot how to reduce a tax bill and it will usually offer a list of ideas, some sensible and some that HMRC would regard as contrived. The PCRT AI guidance includes a scenario in which an AI-generated report recommends an aggressive scheme, and reminds members that the Standards for Tax Planning still apply and that contrived planning must be avoided. If planning fails, clients may claim the extra tax charges, penalties and costs. PI usually responds to negligent advice, subject to the terms, but dishonesty and some scheme-related exclusions can limit cover.
Advisers use AI to brainstorm options for a client's situation, to compare structures, and to draft planning reports. Clients use it too, and increasingly arrive with a chatbot's suggestion and ask the adviser to implement it. A model trained on large amounts of online material will have seen marketed schemes and forum discussions alongside legitimate guidance. It does not reliably tell the difference, and it rarely mentions anti-avoidance rules unless asked.
A second opinion on a chatbot's planning idea is still advice under PCRT, so the adviser cannot treat it as an informal comment.
Illustrative scenario: a company owner brings a planning idea produced by a chatbot. It routes profits through a series of steps that appear to reduce tax significantly. The adviser asks an AI tool to sense-check the steps, receives a confident summary that the structure is effective, and implements it with minor changes. HMRC challenges it under anti-avoidance rules. The client faces the tax, interest and penalties, plus the cost of the dispute, and argues that a competent adviser would have warned that the arrangement was contrived and uncertain.
The risk grows with volume. A firm that uses the same AI prompt to generate planning ideas for many clients may repeat the same flawed structure across its client base, turning one error of judgement into a series of related claims.
Even where the planning is lawful, an AI-drafted report may overstate certainty. Missing caveats about legal uncertainty can feature in planning claims.
Negligent planning advice is a civil liability claim, and the CIOT/ATT PII Regulations require cover for all civil liability from tax services. Whether the client's tax is a recoverable loss depends on whether it would have been paid anyway; costs, penalties and fees for failed planning are more often in issue. Several features can limit cover:

Apex arranges PI for tax advisers, including firms that give planning advice. A broker can check how your wording treats planning work and help you describe it accurately on the proposal.
No. The PCRT AI guidance allows AI use, but the Standards for Tax Planning still apply in full and members must avoid contrived planning. Its scenarios include an AI-generated report recommending an aggressive scheme, which the member must recognise and decline.
If you review or implement it, you are giving advice. The updated PCRT applies to second opinions (para 2.15). You need to assess the idea properly and warn of risks, whatever its source.
The PCRT AI guidance recommends transparency about AI use, including an engagement letter statement (para 1.3) and considering disclosure of actual use when work is delivered. For planning, it is more important still to explain the legal uncertainty and the risk of an HMRC challenge in writing.
Usually PI responds to negligence claims, subject to the policy terms. Cover can be limited by dishonesty exclusions, specific scheme exclusions in some wordings and non-disclosure. Fines and penalties levied on the firm itself are commonly excluded.
