Aipedia: Wealth managers and discretionary fund managers
Discretionary managers can use AI to manage capital gains and wrapper allocations, but the tool is only as good as the base costs and client information behind it. Errors produce unexpected tax bills that clients may claim back.

In short
AI tools may plan capital gains, harvest losses and allocate assets between general accounts, ISAs and pensions in discretionary portfolios. Wrong base costs, allowances used elsewhere and share matching rules are the main error sources. The mandate and client agreement define the firm's tax responsibilities, and many say it does not give tax advice. PI usually responds to claims for tax losses caused by negligent management, subject to the wording, but clients recover only the extra cost of the error, and tax advice outside the policy description may not be covered.
Tax efficiency is a large part of the value discretionary managers offer. AI and rules-based tools may track each client's gains and losses, propose sales that use annual allowances, identify loss harvesting opportunities, manage transfers between general investment accounts, ISAs and pensions, and avoid breaching contribution limits. Some tools propose a full year's tax plan for each portfolio.
These tools depend on accurate cost bases. Holdings transferred in from another manager, corporate actions, reinvested income and historic share matching can all leave the base cost wrong, and an AI tool will optimise confidently on wrong numbers.
Common errors include gains calculated on the wrong base cost, an allowance used twice because a client has assets with another manager, a loss harvest that falls foul of share matching rules so the loss is not available, and wrapper contributions that exceed a limit. Each can produce an unexpected tax bill, interest or a lost relief.
Illustrative scenario: a client transfers a portfolio from a previous manager. The base costs are loaded incorrectly, so the AI tool treats several holdings as standing at a small gain when the gains are large. It recommends selling them to fund an ISA subscription, assuming the gains fall within the client's allowance. The client receives an unexpected tax liability and complains that the firm caused it.
PI covers the professional activities described in the policy. Managing a portfolio tax-efficiently is usually part of discretionary management. Giving personal tax advice, such as on a client's overall tax position or estate planning, may not be, unless it is declared. If an AI tool or a manager strays into tax advice, check that the activity is within the policy description.
Where a client claims an avoidable tax liability arising from negligent management, PI usually responds, subject to the wording and excess. Insurers commonly treat the tax itself differently from extra tax, interest and penalties caused by the error: a client generally cannot recover tax they would always have had to pay. The comparable issues for tax advisers are covered in AI CGT computations for tax advisers and tax advice PI claims.
Apex arranges PI for wealth managers and discretionary fund managers. A broker can check whether your policy covers tax management within discretionary portfolios and any tax advice you give. See does PI cover wealth managers' AI errors and AI in wealth management.
Not usually. Managing a portfolio with tax in mind is commonly part of discretionary management, while advice on a client's wider tax position is a separate activity. Your client agreement and PI policy description should be clear about which you provide.
PI usually responds to claims for loss caused by negligent management, subject to the wording. The client normally recovers only tax, interest or penalties caused by the error, not tax that would have been due anyway.
It helps. The FCA's good-practice page encourages telling consumers how AI is used and its limits. Explaining that tax management depends on accurate cost information and details of assets held elsewhere also encourages clients to keep you informed.
Wrong base costs, especially for holdings transferred from another manager or affected by corporate actions. The tool will optimise on whatever figures it has, so verifying cost history is the most important control.
