Aipedia: Payroll bureaux

Does payroll PI cover AI mistakes?

Payroll bureau PI usually covers a client's claim for a negligent error even when an AI tool produced it, subject to the policy terms. The harder questions are software failure, penalties, contractual promises and what was disclosed to the insurer.

In short

A PI policy normally responds to claims arising from the bureau's professional services, not to how the work was done. If a bureau relies on an AI tool and a competent bureau would have caught the error, the claim is usually treated as negligence and may be covered. Difficulties arise where the loss comes from pure software failure, where the client seeks HMRC penalties, where a contract promises more than reasonable care, or where the insurer was not told about AI-driven services. HMRC, CIPP and insurers have published no statement on AI and payroll PI, so the wording itself decides.

The starting point: negligence, not technology

Most PI wordings for payroll bureaux cover legal liability arising from the conduct of the bureau's professional business, often described as payroll services. They rarely mention AI. The question in a claim is whether the bureau breached its duty to the client, usually the implied term of reasonable care and skill under section 13 of the Supply of Goods and Services Act 1982, and whether that caused the loss.

Using an AI tool does not change that test. A bureau that chooses a tool, configures it, decides how far to check its output and sends the result to HMRC or employees is still providing its professional service. If the error would have been caught by a competent bureau, the claim looks like ordinary negligence.

Negligence versus software failure

The difficult cases are where the bureau did what a competent bureau would do and the tool still failed. If there was no negligence, there may be no liability, so nothing for PI to pay, although defence costs may still be incurred and covered. If the contract made the bureau strictly responsible for accuracy, the client may claim anyway, and some wordings limit cover for liability that exists only because of a contract.

Some policies contain exclusions for the failure of computer systems or software, or for cyber events, which were written with outages and hacking in mind. Whether those catch an AI calculation error depends on the exact words. See cyber exclusions in PI and does PI cover AI mistakes.

Penalties, fines and amounts always owed

Payroll claims often include items PI does not usually pay:

What PI more commonly responds to is the client's consequential loss and defence costs. See fines and penalties under PI and AI and RTI submissions.

Aggregation and limits

AI errors are often systematic. One wrong rule can affect a whole workforce or many clients. Aggregation clauses decide whether those are one claim or many, which affects both the excess and how much of the limit is available. See gross-to-net errors and aggregation of claims.

There is no statutory PI requirement for payroll bureaux. Bureaux inside ICAEW, ACCA, AAT or ICB regulated practices must meet that body's PII rules, which set minimum limits and wording requirements.

What to tell insurers

Insurers decide terms on what they are told. A bureau that has moved from processing to AI-driven compliance checks, status reviews or employee chatbots may have changed its risk. Points worth covering on a proposal form or at renewal include:

The accountants' guide to AI in payroll processing covers the position for practice-run bureaux, and PI for AI-using professionals covers the general market approach.

Frequently asked

Does payroll PI cover mistakes made by AI software?

Usually, where the error amounts to negligence in the bureau's professional service and causes the client a loss, subject to the policy terms. The fact that a tool produced the error does not usually take it outside cover, but software failure exclusions and contractual liability limits can matter.

What if the AI tool failed and the bureau was not negligent?

Then the bureau may have no liability, and PI has nothing to pay except possibly defence costs. If the contract promised accuracy regardless of fault, the client may still claim, and some wordings limit cover for purely contractual liability.

Will PI pay HMRC penalties caused by an AI error?

Usually not. Fines and penalties are commonly excluded and some are uninsurable. PI more often responds to the client's consequential losses and the bureau's defence costs, subject to the wording.

Do I need to tell my insurer I use AI?

It is sensible to describe how you use AI, especially for services beyond processing. Insurers price on the information given, and a clear description reduces the risk of a dispute over disclosure if a claim arises.
