Aipedia: Debt advice firms
AI tools can help triage rent, council tax and energy arrears, but CONC 8.2.2 requires appropriate advice for each UK nation's debt solutions and enforcement rules. Getting priority debts wrong can cost a customer their home or essential supplies.

In short
Priority debts are those where non-payment can lead to the most serious consequences, such as losing a home or an essential service. AI triage tools and chatbots may sort debts and suggest next steps. CONC 8.2.2R/G requires due skill, care and diligence and advice that reflects the different solutions and enforcement rules in each UK nation. CONC 8.5.3G expects repayment offers to allow for debts that could lead to loss of the home or essential goods or services. A tool that treats a priority debt as non-priority, or applies the wrong nation's rules, can cause harm that no later fix can reverse.
Every debt advice session starts with triage: which debts are urgent, which can wait and whether enforcement action is already under way. AI is used to:
The difficulty is that classification depends on context. The same type of debt can carry very different consequences depending on the creditor, the stage reached and the part of the UK the customer lives in.
Skill, care and the four nations. CONC 8.2.2R/G applies Principle 2, due skill, care and diligence, and says firms should give appropriate advice to customers living in different parts of the UK, whose debt solutions and enforcement rules differ. A tool built around one jurisdiction does not meet that standard for customers elsewhere; see AI and debt solutions across UK nations.
Offers that protect essentials. CONC 8.5.3G says offers to lenders should account for obligations such as taxes, fines, child support and debts that could lead to the loss of essential goods or services or the customer's home.
Stopping payments safely. CONC 8.6.1R and 8.6.2R require that advice to stop or reduce payments is demonstrably in the customer's best interests and that the customer is warned of the consequences.
Suitability. CONC 8.3.2R requires suitable advice based on a full assessment. Under the Consumer Duty, firms must avoid foreseeable harm, and loss of a home is about as foreseeable as harm gets.
Illustrative scenario: a customer uploads a bundle of letters. The tool reads a letter about energy arrears as a routine reminder and misses that it refers to a later stage of collection. It recommends including the supplier in a pro-rata plan. The adviser, under time pressure, follows the summary. The customer faces escalating action on a debt that should have been prioritised.
Other common failure points include:
These failures matter more than most, because the consequences are immediate and some cannot be undone by compensation.
If a customer suffers loss because of negligent advice on a priority debt, PI usually responds to a resulting claim subject to the wording, excess and any AI or technology terms. Debt advice PI is voluntary, so the wording governs entirely. The best protection for customer and firm is preventing the error. Apex arranges PI for debt advice firms and can explain how your wording would treat a claim arising from priority debt advice. See the AI in debt advice hub.
Whether a debt is a priority depends on the creditor, the stage of action and the customer's nation. Tools that rely on creditor names or generic rules can misclassify debts, and the consequences, such as losing a home or supply, can be severe and hard to reverse.
CONC 8.2.2G says firms should give appropriate advice to customers living in different parts of the UK, because debt solutions and enforcement rules differ. A tool built for one jurisdiction needs adapting, or a person must check its output, for customers elsewhere.
It can summarise them, but misreading the stage of action is a real risk. Treat the summary as a prompt, have an adviser read any document that suggests court or enforcement action, and record that check.
A claim for loss caused by negligent advice is usually the kind of liability PI addresses, subject to the wording, excess and exclusions. Because debt advice PI is voluntary, ask your broker how your policy treats AI-assisted advice before relying on it.
